Accra High Court to charge Allan Morrison and others for contempt

In the legal tussle between Adamus Resources Limited and Nguvu Mining Limited (1st and 2nd Plaintiffs) and Allan Morrison and Israel Ackah (1st and 2nd Respondents), the Accra High Court (Commercial Division) has charged the 1st and 2nd Respondents with contempt of court proceedings.

Per the contempt charge, Mr Morrison and Mr Ackah are both to be committed to prison.

The order for the 1st and 2nd Respondents to be committed to prison for the contempt charges was given by the High Court Judge on December 22, 2023.

The contempt of court charge slapped Mr Morrison and Mr Ackah follows the intentional act of the 1st and 2nd Respondents of “circulating the interlocutory injunction order made by the Court on 27th July 2023 (the Interlocutory Injunction Order) to individuals not involved in the present case despite the pendency of an application for stay of execution of the interlocutory Injunction Order.”

The Interlocutory Injunction Order by the Court sought the following:

a. The 2nd Plaintiff and its Directors are restrained from taking steps to hold any meeting for and on behalf of the 1st Plaintiff Company purporting to be registered as controller of 1st Plaintiff

b. Angela List, Joseph Owusu-Ansah and Dr Anthony Aubynn are restrained from holding themselves out as Directors of the 1st Plaintiff Company until the final determination of the suit

c. Restraining Odame Sarpong from holding himself out as Secretary of the 1st Plaintiff Company

d. The 2nd Plaintiff and its Directors are restrained from taking any steps pursuant to any share transfer agreement signed by Moses Kobina Bosompem or whoever on behalf of the 2nd Defendant and by Angela List for and on behalf of the 2nd Plaintiff to make the 2nd Plaintiff the controller of the 2nd Defendant (Adamus Resources PTY Limited) from taking any decision in respect of the shares of the 1st Plaintiff
